CLAIMS BILLS
Florida law allows you to collect an excess verdict or judgment against the Government or one of its entities if the legislature passes a claims bill specific to your case. This can only be accomplished after trial or entry of a judgment in your case. The process is risky and time-consuming. It also requires the involvement of a lobbyist to work with the legislature in most cases.
We successfully tried and prosecuted a medical malpractice case for a brain damaged infant against a Tax District Hospital. We presented the excess judgment to the Florida legislature in Tallahassee, successfully obtaining passage of a claims bill that fully compensated the family over and above the Government’s sovereign immunity limits.
A copy of the legislative record showing the claims bill for Nelson v. South Broward Hospital Tax District is attached.
Do not trust a lawyer with your important case when rare experience like this could make the difference.
