“Specifically, although Mr. Chiocca had briefly represented the plaintiff with respect to the 2015 motor vehicle accident, the instant lawsuit is related to a wholly separate, unrelated motor vehicle accident, with different factual circumstances,” the response said. “Although the plaintiff made prior complaints which may be relevant to the defense of this matter, the relevancy does not make the matters ‘substantially similar’ within the meaning of [professional conduct rules] such that Cole Scott & Kissane PA, a firm with more than 600 attorneys statewide, should be disqualified from representing the instant defendants.”

Here is a Florida appellate court decision that may help with that.

During jury selection, Okaloosa County Circuit Court Judge William F. Stone refused to excuse for cause one of the jurors who Seadler flagged as biased. This meant Seadler was forced to use one of his three peremptory challenges to toss the problematic juror, the justices’ opinion said. Seadler was ultimately forced to accept a different juror he didn’t want and would have removed if he only had that challenge, the opinion said.

That assessment has become increasingly true. The U.S. has diverged over the past decade from other comparably developed countries, where traffic fatalities have been falling. This American exception became even starker during the pandemic. In 2020, as car travel plummeted around the world, traffic fatalities broadly fell as well. But in the U.S., the opposite happened. Travel declined, and deaths still went up. Preliminary federal data suggests road fatalities rose again in 2021.

They are not funny things, accidents. In my experience, planes have fallen out of the sky when they are not supposed to. Cars can erupt in flames on unexpected high-speed impacts. Patients stop breathing when their anesthesia is wrong. Children are born to a life of struggle if their distress at birth is not addressed appropriately. Products that fail can cause disfiguring harm, pain, and death.

These are not pleasant things to consider. Maybe you can imagine the difficulty of devoting yourself to fashioning imperfect remedies for these accident injuries. Maybe not. It takes a special kind of person – like Pooh – to keep your head when all about you is upside down.

But these things happen. Nobody is immune. It isn’t healthy to think about at all times but none of us knows what waits for us around the corner. Which has always made the hostility of some toward lawsuits peculiar to me – do politicians who rail against trial lawyers understand that their parents could die of a horrible death of sepsis from untreated pressure ulcers? Do talking heads on the television who mock lawsuits understand that they might need the help of a professional? Do journalists, editors and publishers who try to scandalize verdicts care that their own family might one day need a jury trial to repair a serious loss? Would they refuse to stand up for themselves or would they hire the best lawyer they could find?
