Given recent events, I am going to work on that.

An overlooked aspect of personal injury claims is the stress associated with the litigation, including opening up discovery to the other side and awkward encounters with treaters who are somewhere on the spectrum between skeptical or suspicious and hostile. Especially in serious cases, where the victim constantly in the care of medical professionals.

As I noted a month or so ago, in this post, when Maya’s trial started – these cases are “trying for all involved”.

From the trial of Maya’s case …

Johanna Klink, who was Maya’s bedside nurse in the pediatric intensive care unit, testified that the 10-year-old girl repeatedly cursed at staff and would tell her “I want my effing sedation” during her stay at All Children’s in October 2016, with the nurse using a euphemism for the expletive.

At one point when the two of them were alone in Maya’s room, Klink says Maya told her, “I’m tired of all these lies. My life is a lie.” Klink noted the exact words in Maya’s chart, which was shown to jurors Thursday.

I spend a lot of time with my clients preparing them for all aspects of litigation. This is time well spent because it reduces the stress my clients experience.

Slander, defamation, and invasion of privacy cases are exploding in the internet and conspiracy theory age – where false allegations can be amplified and spread around the globe almost instantly. Review a reported decision that I successfully argued on appeal at the link below. It changed Florida law to help define how these claims are brought and won.

I advise my clients that the pursuit of a medical malpractice claim involves waiving the privacy and confidentiality of the medical issues related to the claim. I think that is customary advice in the legal community.

Trying to parse out what may remain confidential, whether you have a “qualified protective order” or not, is an interesting but unclear area.

Doe’s lawyer explained that the primary caselaw relied on by the defendants, a 1985 Illinois Supreme Court case, Novak v. Rothnam, was inapplicable because in Novak, a psychiatrist testifying at a criminal trial waived the confidentiality of that information. His client’s information was subject to a qualified protective order under the Health Insurance Portability and Accountability Act of 1996, Paris told the justices.

“There was a qualified protective order in this case that made very clear the limits of waiver,” he said. “Here, we have a qualified protective order that says [the waiver is] for the litigation. … The statements that [the firm made] were made outside of court, outside the litigation.”

I have litigated similar issues regarding the duty a hospital owes to relatives of a patient, intentional infliction of emotional distress, wrongful death, and immunity.

Here is a link to the reported appeals decision in my case.

These are difficult cases, trying for all involved. Press attention can help but can also add to the emotional impact on the parties.

The highly anticipated trial in Sarasota will center on the role of Johns Hopkins All Children’s Hospital in the separation of then-10-year-old Maya from her mother, Beata Kowalski, who, after nearly 90 days of being unable to see her daughter because of suspicions that she was making Maya’s condition worse, took her own life in January 2017. The Netflix documentary was released in June.

“Our trial strategy is simple,” the Kowalskis’ attorney Greg Anderson told Law360. “If the truth comes in and I am able to put my case in, I feel very confident that a jury will agree that Maya Kowalski was abused and that Johns Hopkins made an intentional decision to try to force the Kowalskis to agree with their misdiagnosis.”

But the hospital is expected to present evidence at trial that Maya, who arrived at the St. Petersburg hospital on Oct. 7, 2016, significantly underweight and in a wheelchair, did well under the hospital’s care and is living a normal life today. Johns Hopkins maintains that its doctors did their duty as mandatory reporters to report their suspicions of medical abuse to the Florida Department of Children and Families, and it was that agency and a judge who did the investigation and decided to temporarily remove Maya from her parents’ custody.

These thoughts from the Plaintiff’s lawyer ring true based upon my experience.

Anderson, the Kowalskis’ attorney, said he is confident about the facts and the law as it stands applied to the facts, although he says he is concerned about certain pretrial orders excluding evidence that could “cut down the case to something that has no resemblance to what actually happened.”

“If we’re allowed to get the facts in, if the jury’s allowed to hear what actually happened to these folks, I feel very confident,” he said.

My clients in State court with the threat of individual claims did better than clients bundled into a Federal MDL. That’s not to say Mr. Hindi won’t get ‘big-footed’ bu the Big Law MDL community or that his clients will each get the max, however, give credit where it’s do for someone trying to do his best for his clients.

Jibrael S. Hindi, representing the three Florida plaintiffs, told Law360 that he is representing victims of the data breach who went to the HCA facilities in Miami-Dade, Broward and Palm Beach counties. Hindi estimated there are at least 100 people, including children, in those three counties whose data was breached. He is avoiding a class action and plans on filing individual cases in state court, where he believes his clients will receive more justice.
