<p>The establishment in question is a Tallahassee watering hole near the FSU campus frequented by students. Its owner is a locally well-known donor to conservative legislators and the University. If you ignore this and blithely chalk the result up to unidentified &#8220;experts&#8221; cheering, you&#8217;ve done a grave disservice to the plaintiff, the plaintiff&#8217;s lawyer, and especially the jury. What a monumental waste of time and resources.</p>

A new tobacco case on appeal further restricts punitive damage remedies against tobacco companies.</p>
<blockquote><p>Under the law, punitive damages cannot be levied against a defendant if they&#8217;d already been hit with punitive damages for the same conduct, provided the court determines they have already been punished enough, according to the opinion. Sommers had argued the court was wrong not to make this determination, the panel said.</p>

										<content:encoded><![CDATA[<p>There is an update on a story I blogged about <a href="https://thethompsonlawfirm.net/cole-scott-faces-dq-bid-in-fla-crash-suit-over-atty/">here,</a> involving a defense firm disqualified from an auto negligence case because one of its lawyers previously worked for the plaintiff on a prior similar claim.</p>
<p>Apparently, they need the case more than they fear the repercussions, as they are fighting this on appeal (on their client&#8217;s dime).</p>
<blockquote><p>&#8220;Specifically, although Mr. Chiocca had briefly represented the plaintiff with respect to the 2015 motor vehicle accident, the instant lawsuit is related to a wholly separate, unrelated motor vehicle accident, with different factual circumstances,&#8221; the response said. &#8220;Although the plaintiff made prior complaints which may be relevant to the defense of this matter, the relevancy does not make the matters &#8216;substantially similar&#8217; within the meaning of [professional conduct rules] such that Cole Scott &amp; Kissane PA, a firm with more than 600 attorneys statewide, should be disqualified from representing the instant defendants.&#8221;</p></blockquote>

<p>In his groundbreaking 1952 book “Invisible Man,” Ralph Ellison introduces an unnamed African American narrator who relates his story from a basement-dwelling lit with 1,369 light bulbs. This room filled with light represents the man’s choice to see his life more clearly and to seek truth through enlightenment. Although “Invisible Man” was Ellison’s only novel published in his lifetime, more manuscripts were discovered in the award-winning author’s home after he died in 1994.
